
Final Truancy Warning Notice
Dear Parent/Guardian:
School records indicate that your child has 10 (full and/or partial day) or more unexcused absences. Therefore the following applies to your student:
TEXAS EDUCATION CODE SECTION 25.0951 - School District Complaint or Referral for Failure to Attend School (a) If a student fails to attend school without excuse on 10 or more days or parts of days within a six-month period in the same school year, a school district shall within 10 days of the student’s 10th absence refer the student to Truancy Court for truant conduct under Section 65.003(a), Family Code.
AND
TEXAS EDUCATION CODE 25.085 - COMPULSORY SCHOOL ATTENDANCE
The law in the State of Texas requires a child to attend school.
- (a.) A child who is required to attend school under this section shall attend school each school day for the entire period the program of instruction is provided.
- (b.) Unless specifically exempted by Section 25.086, a child who is at least six years of age, or who is younger than six years of age and has previously been enrolled in first grade, has not reached the 19th birthday shall attend school.
- (c.) On enrollment in prekindergarten or kindergarten, a child shall attend school.
- (d.) Unless specifically exempted by Section 25.086, a student enrolled in a school district must attend, if available, an extended year program for which the student is eligible that is provided by the district for students identified as likely not to be promoted to the next grade level or tutorial classes required by the district.
- (e.) A person who voluntarily enrolls in school or voluntarily attends school after the person’s 19th birthday shall attend school each day for the entire period the program of instruction is offered. A school district may revoke the remainder of the school year the enrollment of a person who has more than five absences in a semester that are not excused under Section 25.087, except a school district may not revoke the enrollment of a person under this subsection on a day on which the person is physically present at school.
As a parent, legal guardian, or person standing in parental relation to the child, you are responsible for ensuring your child attends school regularly. You must (1) monitor your student’s school attendance and require the student to attend school with no further unexcused absences, and (2) attend a conference with school officials to discuss the student’s absences. The campus will be contacting you to schedule an Attendance Behavior Improvement Plan Meeting to prevent the accumulation of any further unexcused absences.
