10.1 Update on Temporary Restraining Order
Dr. Ivory-Tatum gave an update on the current status of the Temporary Restraining Order and next steps in the legislative process.
THE TEMPORARY RESTRAINING ORDER (TRO)
- An Illinois circuit court issued a temporary restraining order enjoining the State from
enforcing the Governor’s executive orders and IDPH and ISBE emergency regulations.
- Approximately 150 of Illinois’ 840 school districts and about 700 parents are parties to
the consolidated lawsuit.
- The named "defendants" are temporarily restrained from enforcement of:
Executive Order 18: Indoor Masking in Schools
Executive Order 24 and Executive Order 25: Exclusions for close contacts and contact tracing
Emergency rules issued by IDPH and ISBE
Timing of the TRO and Next Steps:
- Issued end of the day on Friday, February 4 (effective immediately)
- Attorney General filed a motion for stay with the Judge
- Attorney General filed an appeal
Waiting for the Appellate Court to:
- Stay the TRO or Decision on appeal of merits of TRO
- Deadline to respond is Thursday, February 17

minimize disruptions, at this time, the administration recommends the District and the Board maintain our COVID-19 mitigation measures and protocols.
JOINT COMMISSION ON ADMINISTRATIVE RULES (JCAR)
JCAR is a legislative committee that approves regulations for state agencies (i.e., ISBE, IDPH).
Tuesday, Feb. 15: JCAR rejected the Illinois Department of Public Health's (IDPH) request to extend the 150-day emergency rules on school mask mandates because the decision is in front appellate court.
This decision does not change anything; we are still waiting on the appellate court decision because:
- ISBE's emergency rules for masking, excluding close contacts, vaccination, and testing are in JCAR's formal rule-making process. This process can take a long time so we are unsure when a final decision will be made.
- The Governor's Executive Orders were extended on Feb. 4 for 30 days.
