DEADLINE FOR ELECTRONIC VOTING IS December 2, 2023 WHEN ANNOUNCED AFTER THE START OF THE ANNUAL MEETING
BERMUDA BAY BEACH CONDOMINIUM ASSOCIATION, INC. Board of Directors has approved a resolution to authorize electronic voting in accordance with the requirements of Florida statutes. Electronic voting is available now, but you must opt-in. It is our goal to have all homeowners participate in electronic voting. If you have not opted in yet or have not received an invitation via email, please follow the instructions below.

Log in to your community website portal.
Click on ‘Online Voting’ on the Menu Bar at the top of the page.
Scroll down and click on ‘Vote Now’ and follow the instructions.

This makes sure that you vote is secure and easy to do. You will log onto your CA association online account, under the subheading Online Voting
After you click on Online Voting...
It will take you to the Online voting screen. This is IMPORTANT TO DO BEFORE DECEMBER 2.
Select the voter and then submit. This will take you to the ballot!

AMENDMENTS YOU ARE VOTING ON IN LAYMAN'S TERMS - by Susan Hoffman
This is the explanation in layman’s terms as to what each amendment means. You will be voting on each amendment change one by one. Be sure to familiarize yourself with the explanations and know what you are voting for. 75% is needed so YOUR VOTE COUNTS AND IS VERY IMPORTANT.
I. Amendment to Section 9, Paragraph 1: This Amendment updates the Declaration so that common expenses will cover any alterations or improvements to limited common elements or common elements that the Association may undertake.
II. Amendment to Section 12.02: This Amendment clarifies that each Owner is responsible for any limited common element balconies, patios, or enclosures, except for mechanical or structural elements originally installed by the developer, and each Owner is responsible for any other additions or improvements or other features added by the Owner, and eliminates ambiguity with respect to responsibility for maintenance of air conditioning units and other fixtures that may be located outside the unit but that service only that unit.
III. Amendment to Section 13.03, Paragraph 4: This Amendment allows the Board to adopt or amend fees or charges for the use of the common elements, including fees for the storage of oversized vehicles, boats, kayaks, and other storage uses. This would not apply to the ordinary parking of passenger cars.
IV. Amendment to Section 14.02: This Amendment allows the Board to approve an owner’s modification of the exterior of his or her unit.

VI. Amendment to Section 14.04. There are three sections to this Amendment. The first section allows the Board to authorize alterations or improvements to common areas or limited common areas so long as the alteration or improvement does not cost more than $25,000. The second section allows the Board to authorize repair, replacement, or maintenance of any common area or limited common area, even if it involves a material modification, if the repair, replacement or maintenance is necessary! The cost cannot exceed $100,000 unless it is required by law or Milestone Inspection or Structural Integrity Reserve Study (in other words, to keep our property from falling apart). The third section states that in any other case of a necessary repair, replacement or modification (costing in excess of $100,000), a majority vote of Owners voting is required.
VII. Amendment to Section 17.07. When a mortgage holder takes ownership of a unit in foreclosure, this Amendment specifies that the mortgage holder continues to be responsible for all maintenance fees and assessments (including overdue maintenance fees) unless their responsibility is limited by law.
Season’s Greetings!
I feel like I start every letter out with “Oh my gosh, where does the time go?”, But seriously, this year is almost over! It has been a tough one here in Bermuda Bay, but we have had some progress and
successes. It looks like everything is completely in line for Clout to get started on decks in December. Paul Terry will continue to work through any issues for us and keep everything moving forward and progressing. So many moving parts are in motion to make 2024 a year of completed projects and bringing back paradise. The board approved a quote for three roofs to be replaced before the end of the year and for some stump and tree removal as well as the next step to repair all the irrigation lines and issues.
Juliet, along with the landscape and beach committees, have been working very hard at overall cleanup and it is showing. While our grass is still looking brown in a lot of areas the almost 20-acre property is showing some life and improvements.
Our friends from the North are trickling in and the annual meeting and elections are only a few days
away (Dec. 2 nd at the clubhouse and zoom). Please remember to go online and vote for your favorite three candidates and all the amendments and yearly votes to help the next board move into 2024. If you voted before Tuesday the 21 online, YOU MUST VOTE AGAIN if you want your votes to count. When the new ballot options were added to the online portal it totally reset the system back to zero. Please double check that your ballots are what you want them to be.
Our maintenance team has been receiving some help from Tradesmen and really tackling some jobs that have been sitting on the back burner! Please say hi to Luis and our new team member, Kevin, when you see them out. They are really working hard to help bring things together and get all the open work orders in progress.
With Christmas only a month away, please remember your neighbors who may need some extra love or company or meals and the kids who may only get the “Toys for Tots” gift this year.
I feel like a very blessed individual to be able to afford to live in my paradise but there are those around and near us who don’t have everything they need. If you can help someone this season, DO IT.

Luis Rosa - Maintenance Supervisor Bermuda Bay
Luis worked in construction and as a cook while in New York City. He continued this practice when he moved to St. Pete. He worked as a chef at The Birchwood, until he expanded into maintenance. Luis served as head of maintenance for the Bill Edwards Group, until he was relocated to Nashville, Tennessee. He continually worked in the maintenance sector until his placement at Bermuda Bay.
Luis is an avid softball player. He and his brother have played on many different city leagues and in numerous tournaments across the state of Florida. He is a Mud Run enthusiast (Savage Run and Mud Fun Run participant) and recently ran in the Gasparilla race. He has run all four races in one weekend.
Luis is looking forward to working at Bermuda Bay and excited to see what the future holds.

The First Art Marche - November 12, 2023 by Peg Daisley
ART MARCHÉ FOLLOW-UP
This art-inspired event at the clubhouse on November 12th was a huge success, bringing a profit of about $450 from the donated art and craft pieces that were on display for bidders at a silent auction. Some of the 60 pieces that were donated were original, created by Bermuda Bay artists and artisans, and the others were re-sale items donated by owners who were cleaning out their closets and storage units, or looking to swap out old art for new on the walls of their condos. The organizers of the event -- Peg and Roger Daisley, and Roger's sister Dawn Daisley -- would like to thank all the volunteers who helped make this event so special: "Tibi" Bertalan, who provided the perfect piano music to accompany art, wine, and wonderful appetizers -- most of it donated by attendees; Chris Boyd, who took on many of the hostess duties for the hostess who had a bum hip; Donna Veline for doing the same; Carrie Ann Burchett for managing the "wine and water" bar; Lauren Haber for taking photos, and Pam and Chris Burns who showed up like angels to help with the set up, and the clean up, and then stayed afterwards to toast the success of the event. A huge and special thanks goes to the social committee chair, Michelle Lubotina, who provided guidance from beginning to end, including making sure the bidders paid up! Of course, nothing would have happened if Bermuda Bay artists, artisans, and art lovers hadn't gotten involved. The $450 profit has been divided equally between the social committee and the landscaping committee.

WORK ORDER SYSTEM - THAT MAKES "WORK REQUESTS" EASIER FOR YOU
Recently I've been alerted to the fact that several work orders have been closed prematurely, without the work being fully completed or even started in some cases. While it's fine to submit new work orders, a more efficient approach would be for owners to email me directly at bbbmanager@condominiumassociates.com and let me know the condition of the work.This way, I can reopen the existing orders. Reopening helps maintain the chronological order of the queue and preserves any existing notes or photos attached to the original work order.
Please continue to log all your requests and needs through work orders. We are now holding daily meetings to prioritize and ensure efficient, timely completion of these tasks.
Let's keep moving forward into the beautification of the property!

Treasurer’s Report November 15, 2023
Unless otherwise stated, the numbers I am reporting are as October 31.
Bank Accounts
· $794k
Operating Account
· That is very low. We have found the operating account has paid in the past numerous invoices that properly belong to the Reserve Fund. We are in the process of identifying those invoices and repaying the Operating account.
· The biggest over budget item is the liability insurance. It will be about $96k over.
· We are currently projecting a year end surplus in the Operating account. That is primarily due to the 2022 Special Assessment being taken into account during 2023. To avoid putting us into a taxable situation, it is critical that during the December vote, all owners vote in favor of carrying over the surplus into 2024.
Reserve Fund
· The Reserve Fund currently has $516k in the account. The year-end target according to the Reserve Fund Study is just shy of $1 million. This year’s budget only provides for a contribution to the Fund of $350k compared to a recommended $880k. There is no way we are going to meet the target.
· To date, the have been many Stair Project invoices that have been paid by the Reserve Fund. We are in the process of reviewing with the bank to determine how many of these can be applied by the loan. If they can all go through, it could mean about $3/4million which means the Fund will be more inline with the Reserve Fund Study requirements.
Balcony Deposits
· We have $273k of deposits made by owners towards the reconstruction of their respective balconies. This is maintained in a separate bank account and will be withdrawn as each balcony is completed.
Delinquencies
· Delinquencies amount to $23k. That is $1400 worse than last month. Maintenance Fee delinquencies have increased by most of that amount. $12k is more than 90 days old. $9k of that relates to the 2022 Special Assessment.
