What happens when a student with an IEP turns 18?
What is the Age of Majority & How does it impact California Students
When a student turns 18 years of age they are legally considered an adult. This means that they have the right to make important life decisions including living independently, financial management, and continuing or not continuing with school. All rights are transferred from the parent/guardian to the adult student. This applies to ALL students including those with IEPs.
Does the school provide any information on the Age of Majority?
If your student has an IEP, the age of majority is discussed at every IEP meeting.
There is a specific area in the IEP where it is noted when it was discussed with the student and which staff member delivered the instruction.
What if my adult student needs and wants my help after they turn 18?
Our school boards approved a shared decision-making (SDM) document that allows the adult student to appoint a trusted adult to make educational decisions for them.
This document only applies to our schools and only to the educational setting. This permission granted by the adult student to others can be revoked at any time for any reason, by request of the adult student.
What if my adult student with an IEP is very impaired and requires more than an signed SDM document?
When someone is no longer able to handle their own financial or personal affairs, the court can appoint an individual or professional to act on behalf of the incapacitated person.
Please talk to your attorney or Regional Center for additional information. This is a legal process through the courts. The school is not involved.
