Adoption of Consent Agenda Items
The Governing Board voted to accept the consent agenda items. Items listed under the consent agenda motion are considered to be a regular course of procedure and are acted on by the Board of Trustees in one motion.
There is no discussion of these items prior to the Board vote unless a member of the Board, staff, or the public requests specific items be discussed and/or removed from the agenda. It is understood that the administration recommends approval on all consent items. Each item on the consent agenda approved by the Board of Trustees shall be deemed to have been considered in full and adopted as recommended.
Personnel Report
The Governing Board approved the Personnel Report as part of the consent agenda. The Personnel Report reflects staffing changes throughout the District.

Board Policy and Procedure 1330: Community Use of School Facilities
The Governing Board approved the revised Board Policy and Procedure 1330: Community Use of School Facilities as part of the Consent Agenda.One of the roles of the Governing Board is to ensure District Board policies are reviewed, added, removed and kept up to date in order to keep the District legally compliant. The Governing Board discussed and reviewed the following policy at this first reading in order to allow the District to remain in compliance.

Representatives from SchoolWorks presented a summary of the Demographics and Enrollment Projection Study for Cambrian School District to help guide future decisions related to our educational program. The enrollment study outlines enrollment projections from 2014 to 2025 based on existing enrollment, birth rates, Census, and residential development.

2022-23 Local Control Accountability Plan Presentations for Fammatre, Farnham & Price
The Local Control Accountability Plan (LCAP) is a three-year plan that describes the goals, actions, services, and expenditures to support positive student outcomes that address state and local priorities. The LCAP provides an opportunity for our schools and the district to share their stories of how, what, and why programs and services are selected to meet their local needs.
Mrs. Samantha Haley, Fammatre Principal, Mrs. Amy O’Hehir, Farnham Principal and Ms. Margaret Lavin, Price Principal, provided a summary and outlined their 2022-23 Local Control Accountability Plan School Plan. These updates included an overview of the goals, actions and services for improving student outcomes according to the eight priorities set by the state in alignment with the District's Local Control Accountability Plans.

Measure R: Change Orders 3D, 4H, 5B, 5G, 7C, 8E, and 9A - Phase 1 Modernization Projects
Staff recommends that the Governing Board ratify the seven (7) necessary change orders, 3D, 4H, 5B, 5G, 7C, 8E, and 9A, in connection with the Phase 1 Modernization Projects. In accordance with the District's change order approval process, the following change orders are in connection with the Phase 1 Modernization Project to replace the aging HVAC systems at Bagby, Fammatre, Farnham, Sartorette, and Price Middle School.
The total change orders for larger modernization projects typically range from 6% - 8%. The attached change orders total $173,525.67 which represents a 1.55% change of the total contracts listed of $11,210,646.

Resolution 22-23-14: Declaring The Futility of Public Bidding For General Trade Services For Phase 1 Modernizations at Bagby, Fammatre, and Price Schools
The Governing Board approved Resolution 22-23-14 and allowed Cambrian to continue working with Beals Martin & Associates and complete the HVAC General Trade Services for Phase 1 Modernizations at Bagby, Fammatre, and Price Schools.
On March 3, 2022, the Board awarded Beals Martin & Associates the General Trades Contract for the HVAC Project at Bagby, Fammatre, and Price Schools based on their low bid. Due to the various unidentified conflicts between planned new furnace closets and existing conditions, resulting in relocation and modifications, requiring additional expenditures and associated labor costs.
The revisions resulted in a 16.62% increase over the original contracted amount and requiring a resolution to continue with Beals Martin & Associates. It has been concluded that their costs are reasonable and going out to rebid the project would delay the project and result in unnecessary expenses to the District.

The Governing Board approved Resolution 22-23-15 and allowed Cambrian to continue working with Stephen Ciari Plumbing & Heating and complete the HVAC Plumbing Trade Services for Phase 1 Modernizations at Farnham and Sartorette Schools.
On March 17, 2022, the Board awarded Stephen Ciari Plumbing & Heating the Plumbing Trades Contract for the HVAC Project at Farnham and Sartorette Schools based on their low bid. Due to required accessibility (ADA) upgrades for state certification, a 11.12% increase over the original contracted amount was required. A resolution is required to continue with Stephen Ciari Plumbing & Heating. It has been concluded that their costs are reasonable and going out to rebid the project would delay the project and result in unnecessary expenses to the District.

Budget: First Interim Report 2022-23
The Governing Board approved the First Interim Report with actual results as of 10-31-22, find that the District will be able to meet its financial obligations through 6-30-23 and two subsequent years, and, authorized the Board President to certify and file a "positive" financial certification statement with the Santa Clara Office of Education.
Education Code Sections 35015 and 35035 (g) require school district governing boards to certify their district's projected year-end and subsequent years financial condition twice a year. The certification shall be based upon required financial and budgetary reports, cumulatively entitled the "Interim Report".
After reviewing the Interim Report, the County Office of Education can make one of three certification statements. They are: (1) positive certification, meaning the District is and will remain, financially solvent through fiscal year-end and two subsequent years, provided appropriate adjustments are made; (2) qualified certification, meaning that if certain events do or do not occur, the District will not be able to meet its financial obligations; and (3) negative certification, meaning that the District will not be able to meet its financial obligations through fiscal year-end or two subsequent years.

Senate Bill 1479: California Department of Public Health (CDPH) COVID-19 Testing Framework for K12 Schools
The Governing Board adopted the California Department of Public Health Framework for K12 Schools for the 2022-23 school year. Pursuant to Senate Bill 1479, Every California school district shall create a COVID-19 testing plan, or adopt the State Department of Public Health’s framework, that is consistent with guidance from the State Department of Public Health by January 1, 2023.

Statement of Votes and Certificate of November 8, 2022, Election Results (Elections Code 15400)
The Governing Board accepted the Statement of Votes, the Certificate of Election Results, and declare the final results of the November 8, 2022 election. Pursuant to Elections Code Section 15400, the governing body shall declare elected or nominated to each office voted on at each election under its jurisdiction the person having the highest number of votes for that office, or who was elected or nominated.
The Cambrian Governing Board accepted the Statement of Votes, the Certificate of Election Results, and declared the totals to be the final results of the November 8, 2022 election.

Organizational Meeting: Board Calendar for 2023-24
The Governing Board approved the 2023-24 calendar for the Board of Trustees meetings. At its annual Organizational Meeting the Board determines its meeting dates for the calendar year. The Board meets the first and third Thursday of each month excluding July and months where the schools are closed during the first or third week of the month.

Organizational Meeting: Naming of a Board Representative to the Santa Clara County Committee on School District Organization 2023
The Governing Board of Trustees selected xxx xxxx to vote in the election for members of the County Committee on School District Organization in 2023.
The Santa Clara County Office of Education recommends that the Governing Board select a Cambrian Board Member to vote in the election for members of the County Committee on School District Organization in 2023.
California Education Code § 35023 requires that the governing board of each school district select one of its members to vote in the election for members of the County Committee on School District Organization at its annual initial meeting.
The County Committee Election ballot comes to each district in late October/early November and the board member named will vote in the 2023 County Committee election.
The County Committee Board Representative is NOT a member of the County Committee and is NOT required to attend County Committee meetings.

Unexpired Term Fulfillment: Board Member Vacancy
Governing Board provided direction to staff in regard to the recent board vacancy of Mr. Donald Rocha.
Whenever a vacancy occurs as defined in Government Code Section 1770, the procedure for filling a vacancy on the Cambrian Governing Board of Trustees is established by Education Code section 1008 and 5090-5093 and the process is set forth in Board Bylaw 9223 which requires that the Board order a special election or make a provisional appointment within 60 days of the vacancy.
Cambrian Trustee Donald Rocha was recently appointed to the Santa Clara County Board of Education and the Cambrian Governing Board discussed the process and schedule to fill the Board vacancy.

Next Board Meeting
The next meeting of the Cambrian School Board will be held Thursday, January 19, 2023 at 7 p.m. Meetings are held in person at the Professional Development Center located at 4115 Jacksol Drive, San Jose 95124 in Building 7, and can be viewed online as well. Agenda and login information will be available the week of the Jan. 19th meeting. The meeting is open to the public.
