Bilingual Exception and ESL Waivers
2021-2022 Bilingual Exception/ESL Waiver
Teacher certification requirements for serving English learners and providing equitable access to the appropriate bilingual education or ESL program have not changed.
- If the LEA does not have the appropriately certified teachers to implement the bilingual education and/or ESL program, the LEA must apply for a bilingual education exception and/or ESL waiver on or before November 1st, 2021.

Resources
LPAC - October Activities
- Review and update PEIMS data for Snapshot Date
- Schedule and conduct LPAC meetings to review academic progress for Struggling EBs and identify appropriate interventions
- Review teacher certifications and credentials to prepare for State Bilingual Exceptions and/or ESL Waivers
- Review the annual Exceptions and Waivers webinar on the ELL Portal
- Complete the documentation for the waiver and exception, if necessary
- Collaborate with District Testing Coordinator (DTC)
- Identify TELPAS verifiers and returning TELPAS raters
- Monitor and review students grades after 1st 6/9 weeks grading period
- Prepare for RDA reports and update improvement plans

- LPAC for new enrollees within 4 calendar weeks
- Monitor linguistic and academic progress
- Ongoing collaboration with special programs such as Special Education, Advanced Academics-Gifted and Talented, etc. to ensure student success

This document serves as a tool for Local Education Agencies (LEAs) to align with each program’s statutory authority, policies, and practices. The terms Local Education Agency (LEA) and School Districts are used interchangeably throughout this document.
